The Depository Institutions Deregulation and Monetary Control Act of 1980 (DIDMCA) is arguably one of the most important laws impacting financial services by allowing state-chartered banks the ability to compete with their national counterparts. Four decades later, the act is still playing a pivotal role and remains significant in the evolving landscape of financial regulation and fintech lending. In the wake of Madden and multiple divers challenges to True Lender, opting out of DIDMCA has become a blunt legislative tool by some states to limit responsible lending through bank-fintech partnerships.
