OH: AFC Testimony in Support of SB 269

Thank you Chair Wilson, Vice Chair Lang, Ranking Member Craig and members of the Senate Financial Institutions, Insurance and Technology Committee for the opportunity to submit written testimony regarding of Senate Bill 269 (SB 269).

AFC is the premier trade association representing the leading financial technology (fintech) companies, including fintech lenders, buy-now-pay-later providers, and the innovative community banks that power them. AFC’s mission is to promote a transparent, inclusive, and customer-centric financial system. A core part of our mission is supporting responsible innovation and sound public policy in Finical Services.

We applaud Senator Lang for introducing SB 269 bill to address the important matter of how bank-fintech lending issues are regulated in Ohio. We are also grateful for the deliberative nature of  the Ohio legislature, as we believe this bill would benefit from additional debate.

As the trade association representing responsible fintech companies, AFC wants to ensure that Ohio builds a pragmatic policy framework to regulate the fintech industry. As such, we do not believe the bill goes far enough in addressing the nuances of banks-fintech partnerships. Nor do we believe that SB 269 addresses the Ohio Division of Financial Institutions’ (ODFI) desire for oversight of fintech companies as demonstrated in their December 2024 Bank Partnership Guidance.

AFC looks forward to continued engagement with Senator Lang and this committee to support legislation that delivers both access to credit consumer protection for Ohians. Thank you again for the opportunity to offer our testimony regarding for SB 269.
